AGC reviewing candidate selection for proposed separation of top legal roles

KOTA BARU: The Attorney-General’s Chambers (A-GC) is reviewing provisions on the selection of candidates under a proposal to separate the roles of the attorney-general and public prosecutor.

Attorney-General Tan Sri Mohd Dusuki Mokhtar said this followed the tabling of the Bill on the proposed separation.

“The Bill on the proposed separation of the roles of attorney-general and public prosecutor has been tabled and has gone through the proper process, including consideration by the Parliamentary Special Select Committee (PSSC).

“On the issue of candidates, we are reviewing a provision concerning how they should be selected,” he said.

He was speaking at the opening and handover of recreational facilities under the Attorney-General’s Chambers’ Kampung Angkat Madani programme in Kampung Kok Lanas yesterday.

Reports previously stated the PSSC would resume its meeting after receiving feedback from the A-GC on the proposed separation of the roles.

Minister in the Prime Minister’s Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said said the A-GC had been given two weeks to provide a detailed response.

On Mar 3, the Constitution (Amendment) Bill (No. 2) 2026, which seeks to separate the roles of attorney-general and public prosecutor, was referred to the PSSC.

Under the proposed framework, the public prosecutor would oversee all criminal prosecutions, while the attorney-general would serve as the government’s legal adviser on matters other than criminal law.

The public prosecutor would be appointed by the Yang di-Pertuan Agong at His Majesty’s discretion, on the advice of the Judicial and Legal Service Commission, after consulting the Conference of Rulers.

The proposal differs from the current arrangement, under which the attorney-general is appointed by the Yang di-Pertuan Agong on the advice of the Prime Minister.

Meanwhile, Dusuki said RM500,000 had been allocated to upgrade public facilities and improve residents’ well-being under the Attorney-General’s Chambers’ Kampung Angkat Madani programme in Kampung Kok Lanas.

He said the infrastructure improvements covered not only physical facilities but also supported healthy lifestyles, small-scale economic activities and the well-being of the local community.
