KUALA LUMPUR: A father who committed incest against his teenage daughter, resulting in her giving birth to his child, was jailed for 12 years and ordered to receive five strokes of the rotan by the Sessions Court.
The 52-year-old man, who pleaded guilty to the offence, was ordered by judge Mohd Kafli Che Ali to begin serving his sentence immediately.
The court also ordered him to undergo counselling and placed him under police supervision for two years.
The offence was committed against his daughter, who was 13 years and 10 months old at the time, at a house in Bandar Tun Razak, Cheras, at 12.30am in November 2020.
The charge under Section 376B of the Penal Code carries a jail term of between 10 and 30 years and whipping upon conviction.
Deputy public prosecutor Noor Shakira Aliana Alias sought a heavy penalty, saying the accused had betrayed his daughter’s trust.
She said the victim had suffered the consequences of the accused’s actions, having become pregnant and given birth to a child who is now 5 years old.
“The victim longed for her father as she missed him after he divorced her mother.
“He took advantage of the victim’s innocence to satisfy his lust, when he should have been the one protecting his own daughter,” she said.
The accused, who was unrepresented, pleaded for leniency due to his health conditions.
